1. Acceptance of Terms

By downloading, installing, or using Sally: Your Fasting Companion (“the App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App. These Terms constitute a legally binding agreement between you and Sally App.

2. Age Requirements

You must be at least 17 years of age to use Sally. If you are between 17 and 18 years of age, you should use the App only with the knowledge and consent of a parent or guardian. Fasting is not recommended for children or adolescents without explicit medical supervision and guidance.

By using the App, you represent and warrant that you meet the minimum age requirement.

3. Description of Service

Sally is an iOS application that provides:

• Intermittent fasting tracking and protocol guidance
• Sole water intake tracking and scheduling
• An on-device AI wellness assistant (Sally AI) powered by Apple Foundation Models
• Science-backed educational content about fasting
• Configurable reminders and notifications

All App functionality operates locally on your device. Sally App does not operate cloud servers for storing user health data.

4. Health and Safety

4.1 Contraindications

Fasting may be dangerous or contraindicated for individuals who:

• Are pregnant or breastfeeding
• Have or have had an eating disorder
• Have type 1 or type 2 diabetes
• Have cardiovascular disease or a history of heart problems
• Are underweight or have nutritional deficiencies
• Are taking medications that require food intake
• Have a history of hypoglycemia
• Are under 18 years of age (without medical supervision)

This list is not exhaustive. Consult your healthcare provider before beginning any fasting program.

4.2 User Responsibility

You assume full responsibility for your use of the App and any fasting activities you undertake. Sally App is not responsible for any health outcomes resulting from your use of the App. If you experience adverse symptoms during fasting — including severe dizziness, chest pain, difficulty breathing, confusion, or fainting — stop your fast immediately and seek medical attention.

5. Sally AI Disclaimer

The Sally AI assistant is a general-purpose wellness companion powered by Apple Foundation Models. Responses from Sally AI:

• Are not medical advice
• May not be accurate, complete, or applicable to your individual situation
• Should not replace consultation with healthcare professionals
• Are generated by an AI model and may occasionally contain errors

You should independently verify any health information before acting on it. Sally App is not liable for decisions made based on Sally AI responses.

6. Intellectual Property

The App, including its interface, design, code, content, branding, scientific content, and Sally AI system prompt and behavior, is the intellectual property of Sally App and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may not: copy, modify, distribute, sell, or reverse engineer any part of the App; remove any proprietary notices; or use the App for any commercial purpose without our express written consent.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Sally App and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, or other intangible losses, resulting from your use of or inability to use the App. Sally App's total liability to you for all claims shall not exceed the amount you paid for the App (if any) in the twelve months prior to the claim.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the “Last Updated” date and, where appropriate, through an in-app notice. Continued use of the App after such changes constitutes your acceptance of the new Terms.
